A 57-year-old Acworth man was booked into the Floyd County Jail Monday on felony warrants charging him with exploitation of a disabled adult and theft by deception.
According to the warrants:
David Allen Berman notarized a document giving Russell Eugene Smith power of attorney over the finances and resources of a disabled adult who suffers from dementia and is confined to a nursing home.
More than $25,000 was taken from the victim.
Berman admitted to not being present when the document was signed and did not witness the signature.
He is additionally charged with violation of notary duties.
Smith was arrested last week on charges of theft by deception, unauthorized practice of law, and exploitation of the elderly or disabled.
According to those warrants, Smith held a series of meetings with two women and one meeting with a third woman at the nursing home in South Rome, stating he was a lawyer.
